1. Ownership of the domain

In compliance with Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), we inform you that the domain of our online shop, www.detectalia.com, is owned by Detectalia Europe, S.L., a company legally incorporated in Spain with CIF B54096318 and registered in the Registro Mercantil de Alicante Doc. 1/2008/11.703,0 Diario 241 Asiento 800 Tomo 3032 Libro 0 Folio 204 Hoja A-97946 Inscrip. 2 (hereinafter, Detectalia.com). 2. Purpose and scope of application

The purpose of these General Terms and Conditions of contract and use is to govern the provision of the information supplied in the Detectalia.com online shop, as well as the commercial transactions arising between Detectalia.com and the users of the www.detectalia.com domain. Purchasing any of the products offered in the shop implies acceptance by the user, without reservation of any kind, of each and every one of these general terms and conditions of contract and use. Detectalia.com may at any time and without prior notice amend these general terms and conditions, as well as any particular conditions that may be included, by publishing such amendments in the shop so that users can be aware of them, with the date of such amendments being placed on record.

3. Information provided on the website

Detectalia.com reserves the right to modify the commercial offering (products, prices, promotions and other commercial and service conditions) presented at www.detectalia.com at any time. We make every effort to ensure that the information contained on the website is truthful and free of typographical errors. Should an error of this kind occur at any time, at all times beyond the control of www.detectalia.com, it would be corrected immediately. If a typographical error existed in any of the prices shown and a customer had made a purchase decision based on that error, we will inform the customer of the error and the customer will be entitled to rescind the purchase at no cost whatsoever. Likewise, the website content may occasionally show provisional information about some products. If the information provided did not correspond to the characteristics of the product, the customer will be entitled to rescind the purchase at no cost whatsoever. All contractual information on www.detectalia.com is displayed in Spanish (Castilian), and communication with customers and users, as well as the formalisation of the contract, will be carried out in that language.

4. Intellectual and industrial property

All content published in the shop and especially the designs, texts, graphics, logos, icons and buttons, as well as the software, trade name, trademarks or industrial designs and any other signs capable of industrial and commercial use, are subject to intellectual and industrial property rights held by Detectalia.com or by third-party owners who have duly authorised their inclusion on the website. In no case shall it be understood that any licence is granted, or that any waiver, transfer, or total or partial assignment of such rights takes place, nor is any right or expectation of right conferred — in particular, of alteration, exploitation, reproduction, distribution or public communication of such content — without the prior express authorisation of Detectalia.com or the corresponding owners. The insertion of hyperlinks for commercial purposes on websites unrelated to Detectalia.com that allow access to our website without prior consent is expressly prohibited. In any event, the existence of hyperlinks on third-party websites shall in no case imply the existence of commercial or business relations with the owner of the website where the hyperlink is placed, nor acceptance by Detectalia.com of its content or services.

5. Liability of Detectalia.com

The products presented on the website comply with Spanish legislation. Detectalia.com's liability cannot be invoked in the case of products that do not comply with the legislation of the countries to which they may have been sent in accordance with the customer's order. It is therefore up to customers outside Spain to verify the possibility of importing or using the products they order from us. The user assumes all liability arising from the use of our website, being solely responsible for any direct or indirect effect arising in relation to the website, including, by way of illustration and not limitation, any adverse economic, technical and/or legal result, as well as the disappointment of expectations generated by our website, and the user undertakes to hold Detectalia.com harmless from any claims arising, directly or indirectly, from such events. Detectalia.com accepts no liability for any damage that may arise from interference, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operation of this electronic system or in users' devices and computer equipment, caused by reasons beyond Detectalia.com's control, that prevent or delay the provision of services or browsing of the shop, nor for delays or blockages in use caused by deficiencies or overloads of the Internet or other electronic systems, nor for the impossibility of providing the service or allowing access for reasons not attributable to Detectalia.com, due to the user, third parties or force majeure. Detectalia.com does not control, in general, the use that users make of the website. In particular, Detectalia.com does not guarantee under any circumstances that users use the website in accordance with the law, these General Terms and Conditions, generally accepted morality and good customs and public order, nor that they do so diligently and prudently.

6. Obligations of customers and users

In general, the user undertakes to comply with these general terms and conditions, as well as with the special warnings or instructions for use contained in them or on the website, and to act at all times in accordance with the law, good customs and the requirements of good faith, using due diligence and refraining from using the website in any way that may prevent, damage or impair its normal operation, the assets or rights of Detectalia.com, its suppliers, the other users or, in general, any third party. Access to and use of the portal by minors without the express consent of their parents is prohibited; Detectalia.com is not responsible for the truthfulness and accuracy of the data entered by the user and therefore cannot verify users' ages. Specifically, and without this implying any restriction on the preceding paragraph, when using the website www.detectalia.com the user undertakes to:

• Provide truthful information on the data requested in the user registration or order form, and keep it up to date.
• Not introduce, store or distribute on or from the website any information or material that is defamatory, insulting, obscene, threatening or xenophobic, that incites violence or discrimination on grounds of race, sex, ideology or religion, or that in any way offends against morality, public order, fundamental rights, civil liberties, or the honour, privacy or image of third parties and, in general, against current regulations.
• Not introduce, store or distribute through the shop any program, data, virus, code or any other electronic or physical device capable of causing damage to the website, to any of the services, or to any of the equipment, systems or networks of Detectalia.com, of any other user, of Detectalia.com's suppliers or, in general, of any third party.
• Keep safe the 'username' and 'password' provided by Detectalia.com, accepting responsibility for any damage that may arise from their improper use.
• Not carry out advertising or commercial exploitation activities through the website, and not use its content and information to send advertising or messages for any other commercial purpose, nor to collect or store third parties' personal data.
• Not use false identities or impersonate others when using the website or any of its services, including the use, where applicable, of third parties' passwords or access codes or in any other way.
• Not destroy, alter, use for their own purposes, disable or damage the data, information, programs or electronic documents of Detectalia.com, its suppliers or third parties.
• Not introduce, store or distribute through the shop any content that infringes third parties' intellectual or industrial property rights or trade secrets, nor in general any content which they do not, in accordance with the law, have the right to make available to third parties. The customer undertakes to make delivery of the order possible by providing a delivery address at which it can be delivered within normal goods delivery hours. In the event of non-compliance by the customer with this obligation, Detectalia.com shall bear no responsibility for the delay or impossibility of delivery of the order placed by the customer.
• For devices received for repair quotations, the product will be stored and kept free of charge for a period of three months; if after that period no information has been received regarding its acceptance or return, it will be destroyed.

7. Privacy and protection of personal data

Detectalia.com informs you of the existence of a personal data file created by and under the responsibility of Detectalia.com with the data obtained on the website www.detectalia.com. The purpose of this file is to manage your contractual relationship with us, as well as to carry out promotional and advertising activities, our own or those of third parties, by any means, including the sending of commercial messages via SMS, email and post, that may be of interest to you, based on the study and segmentation of the data collected while browsing the website, the data provided by completing any form, and the data derived from the commercial relationship or the delivery of the products purchased. If you do not wish to receive advertising, simply go to your account and deactivate the sending of newsletters and information. Customers and users of www.detectalia.com may at any time exercise their rights of access, rectification, erasure and objection in respect of their personal data by writing to: Detectalia.com España, Departamento de Atención al Cliente, Calle Andalucía 6, Polígono Industrial El Pastoret, 03640 Monóvar (Alicante), or by sending an email to info@detectalia.com, stating their name and surname and the username and email address with which they registered, and in both cases attaching a photocopy of the user's identity document (DNI). If the data supplied is associated with a purchase, Spanish law requires us to keep it for at least six years, so it cannot be deleted or rectified even if the customer so requests. Detectalia.com undertakes, in the use of the data included in the file, to respect its confidentiality and to use it in accordance with the purpose of the file, as well as to comply with its obligation to store it and to adopt all measures to prevent alteration, loss, or unauthorised processing or access. Our secure server guarantees the privacy of the data you send us by means of the SSL protocol, encrypting the data sent so that no one can appropriate it. You can check that your browser is secure if the padlock symbol appears and the URL begins with 'https'.

8. Cookies

We also inform you that, in order to improve your browsing experience, manage the contents of your basket, offer you our personalised recommendations and inform you online of our offers for customers or partners, our website uses cookie-installation and IP-storage devices. A cookie is a file that we place on your device whose sole purpose is to simplify your browsing on www.detectalia.com (this cookie cannot contain viruses or be executed, as it is not an active file). The cookie can only be read by Detectalia.com and by you, and you can delete it whenever you wish via your browser settings.

9. Delivery costs

Delivery is free on orders over €99. The applicable delivery costs are shown in the basket when you place your order. Non-receipt of the order for reasons beyond Detectalia's control, or cancellation of an order already dispatched, will give rise to payment of the transport costs incurred.

10. Placing an order

To place an order you must connect to www.detectalia.com and register as a user, completing the electronic form that appears on the website and following the instructions given in it. Acceptance of these general terms and conditions is essential in order to register as a customer and process the order. After registering, and in order to purchase products, you must add the product you wish to buy to the basket, following the on-screen instructions, completing the order form provided for this purpose and validating it. Validation of the order by the customer expressly implies knowledge and acceptance of these general terms and conditions of contract as part of the conclusion of the contract. Unless proven otherwise, the data recorded by Detectalia.com constitutes proof of the set of transactions carried out between Detectalia.com and its customers. Detectalia.com will file the electronic document in which the contract is formalised, and it will be accessible. Once the purchase has been made, and as soon as possible — always within 24 hours of the execution of the purchase — Detectalia.com's Customer Service will send you proof of purchase by email. If you do not agree with the details set out in that confirmation, you may request that they be amended or that the contract be cancelled before your order is dispatched. You can also place your order by email by sending the official order form that we will provide you with.

11. Product availability

The selection of products offered at www.detectalia.com is valid for as long as the products are visible on the website, subject to available stock. Delivery times are calculated in days from Monday to Friday, since Detectalia.com does not dispatch on public holidays, Saturdays or Sundays. In the event of a stock shortage or the occasional unavailability of an item, Detectalia.com will contact you immediately to inform you and give you a new delivery time or, if it is not possible to supply the product, to cancel it.

12. Delivery methods and times

The products are sent to the delivery address you have indicated in your order. If the address provided is incorrect, a new delivery will be made to the correct address at the customer's expense. In exceptional cases, Detectalia.com reserves the right to split the order, sending the available items and leaving the unavailable items for a second delivery; in this case, the second delivery is made at no additional cost. From your shopping basket you can select the type of delivery you wish according to the area and the delivery method you prefer. The transport and delivery of orders are carried out with the courier company UPS. No deliveries are made on Saturdays, Sundays or public holidays. The delivery times shown on the website are approximate; Detectalia accepts no liability for delay in the delivery of the order unless there is a difference of at least 72 hours between the stated delivery date and the actual one. If the customer detects any problem at the time of delivery of the order (damaged packaging, missing or damaged products), they must note it in writing on the carrier's delivery note so that the carrier's insurance covers the repair or replacement of the order. The packaging shows the product being sent; if you would like this to be concealed, let us know in the order comments.

13. Payment

Detectalia.com offers you various payment methods so that you can choose the one that best suits your needs:

• Payment by credit card: you can use Visa, MasterCard and Amex.
• Payment by bank transfer: the bank details are provided during the purchase process. It is very important that in the SENDER or PAYER field you state the following: order number — your name and surname. You have 7 working days to make the transfer after placing your order. The order will not be considered effective until we confirm the corresponding payment into any of Detectalia.com's bank accounts (indicated while the order is being processed) and, therefore, delivery times start to run from that date.

14. Right of withdrawal

If you are not satisfied, you may return all items except software, accessories, collection and delivery services for updates, and the banknote steriliser, the latter being considered a professional healthcare product. In the exceptional case that a customer sends a product which, after inspection by our technicians, cannot be updated, a discount voucher for the same amount with perpetual validity will be issued, as with product returns. You must send the product at your own expense to Detectalia.com's registered office in Monóvar (03640, Alicante), Calle Andalucía 6, Polígono Industrial El Pastoret, attaching to the outside of the parcel, in a visible place, the purchase invoice and a written note clearly stating that you wish to return the item (parcels without these documents attached will not be accepted, as Detectalia.com would be unable to identify the origin and intentions of the sender). The delivery costs for an exchange or return must be borne by the customer. The maximum period for a return or exchange is set at 14 calendar days from receipt of the order and arrival at Detectalia.com's registered office indicated above.

The item must be in perfect condition, with its original packaging and accessories, and must not have been used. If, after inspection, any deficiency is found in the item or any accessory is missing, the customer will be informed of the situation. If a deficiency is found in the item, the customer will be informed and the item returned at the customer's expense. If an accessory is missing, the customer would be informed so that they can send it, with an additional 3 working days from that notification to resolve the situation; otherwise, the customer will be informed and the item returned carriage forward. In both cases, the delivery cost will be €11.95, payable on delivery. If the packaging is damaged, the amount to be deducted will be €10. In promotions involving orders with free delivery, the return transport cost will be deducted from the customer's refund and is likewise set at €11.95.

For purchases within the EU, in the event of a malfunction on delivery of the machine, the customer may qualify for a free return if they report the incident within 24 hours of delivery.

15. Product warranty and after-sales service

We offer a two-year warranty on all our products, although it does not cover defects caused by negligence, knocks, incorrect use or improper handling, incorrect installation, or materials worn out through use. Since 21 August 2018, the warranty is extended to 4 years free of charge for purchases made at www.detectalia.com on completion of the quality form you will receive by email up to 14 days after making the purchase. If you wish to obtain it by other means, you can contact Detectalia at ventas@detectalia.com. The exception is the steriliser, which is a professional-use product with a one-year warranty.

• The place of service and provision of warranty service will be our premises.
• For incidents that justify use of the warranty, the remedy will be repair, replacement of the item, price reduction or refund, under the terms established by law.
• The warranty will be invalidated if any attempt is made to access the inside of the machine, or if it is updated with software not supplied by Detectalia or with the software of another model.
• If the defect turns out to have been caused by misuse or by use not in accordance with the product manual, the repair will be invoiced. The cost per hour or fraction thereof is €49 + VAT.
• Detectalia Europe S.L. reserves the right to repair or replace the product with one in a similar or newer state of use than the one sent in by the customer for repair under warranty. The defective parts or unit will become the property of Detectalia.
• The motor of the Detectalia V75, V100, V800, M5 and M8 models requires annual maintenance, which will be carried out by Detectalia to ensure the correct operation of the devices. The cost of this maintenance will depend on the use and condition of the device and will be communicated to the customer once it has been received by Detectalia. The customer may send the product at their own expense to the address indicated in point 14 of these general terms and conditions, or contact Detectalia via the form provided at www.detectalia.com/contacto to request collection. If this maintenance is not carried out, the warranty will be invalidated. In the case of the D7X and other one-note-at-a-time banknote detectors, maintenance is likewise annual as regards the sensors.
• Refurbished products carry a one-year warranty. These products are refurbished expressly for the customer who orders them and therefore returns are not accepted.

Repairs carried out during the warranty period will not extend its duration and are themselves guaranteed for a period of three months starting from the moment the repaired unit is returned to the customer. If the incident is not considered to be covered by the warranty, all costs arising from the return delivery and repair of the device will be borne by the customer. In any event, delivery to our premises is at the customer's expense.

Regarding the storage of products sent in for repair, the corresponding quotation will be sent to you and the products will be stored free of charge for 60 days; after that period, and if no information has been received in this regard, the product will be destroyed. Do not send accessories or other parts of the machine that are not going to be repaired; they may be left out of the return delivery.

16. Applicable law. Jurisdiction

Purchases made at www.detectalia.com are subject to Spanish law. For the resolution of disputes, the parties submit, at their choice and waiving any other jurisdiction, to the courts and tribunals of Novelda (Alicante). These General Terms and Conditions of Contract were last updated on 05-06-2023.
